Terms of Service

These Terms of Service ("Terms") govern your use of the TenX learning app and related services (the "Service") provided by Silmaril Technologies Inc. ("Company", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. Users under 18 should have permission from a parent or legal guardian. The Service is not directed at children under 13, and we do not knowingly collect information from them.

2. Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and current information when creating an account.
• You are responsible for all activities that occur under your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload content that infringes intellectual property rights or contains malware.
• Attempt to reverse-engineer, decompile, or interfere with the Service.
• Use the Service to harass, harm, or deceive others.
• Use automated systems (bots, scrapers) without our written permission.

4. AI-Generated Content

The Service uses AI to analyze problems and generate hints, explanations, and solutions. AI output may contain errors or inaccuracies. You should verify AI-generated content before relying on it for academic, professional, or exam purposes. We are not responsible for consequences arising from reliance on AI-generated content.

5. Subscriptions and Payments

• Subscriptions are billed through the Apple App Store, Google Play, or Stripe, as applicable.
• Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before renewal.
• Cancellations take effect at the end of the current billing period; you retain access until then.
• Refunds are handled according to the policies of the respective payment platform.
• Prices may change with prior notice; changes will not affect existing billing periods.

6. Intellectual Property

The Service, including its software, design, trademarks, and original content, is owned by the Company and protected by intellectual property laws. You retain ownership of the problem images you upload, but grant us a limited license to process them as necessary to provide the Service.

7. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through Account Settings. Upon termination, your access to the Service ends and your data will be handled as described in our Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or produce specific academic outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, the Company's total liability for any claim arising out of or relating to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Governing Law and Disputes

These Terms are governed by applicable laws of the Company's jurisdiction. Disputes shall be resolved through good-faith negotiation first; if unresolved, through the competent court or arbitration body as specified in the final Terms after legal review.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app with reasonable advance notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
